ERISA law ensures plan members receive a summary description of benefits, have appeal rights, and can file a suit for unpaid claims. These interim final rules implement provisions of the No Surprises Act that protect participants, beneficiaries, and enrollees in group health plans.One of my responsibilities while employed in this role was to look for new and novel theories for finding liability under ERISA. A panel of experienced professionals outlining challenges to denial of outofnetwork payments based on feeforgiveness provisions. This includes regularly advising clients regarding ERISA fiduciary duty provisions and the prohibited transaction rules of ERISA and the Internal Revenue Code. In this month's issue, our authors address severance benefit claims and ERISA disclosure requirements.
