Only employers who offer their employees retirement, health, or other employer-sponsored benefits must comply with ERISA requirements. Notwithstanding, government employers are not subject to ERISA even though they offer pensions and healthcare benefits as part of their compensation packages.

Under ERISA, government plans, including those sponsored by federal, state, or local governments, are explicitly exempted from ERISA's provisions. See 29 USC §§ 1002(32) 29 and § 1003(b).

ERISA protects employees who participate in certain health and retirement plans at private organizations. The law applies to many types of employers, including sole proprietorships, S corporations, C corporations, limited liability companies, and partnerships.

Employer-sponsored group plans are subject to ERISA. This includes self-insured health plans, which typically aren't subject to state insurance laws. ERISA exempts these self-funded plans from certain state laws. Fully insured health plans are also subject to the regulation and any applicable state insurance laws.

Most private sector health plans are covered by the Employee Retirement Income Security Act (ERISA). Among other things, ERISA provides protections for participants and beneficiaries in employee benefit plans (participant rights), including providing access to plan information.

Under ERISA, each person must be bonded for at least 10% of the $1 million or $100,000. (Note: Bonds covering more than one plan may be required to be over $500,000 to meet the ERISA requirement because persons covered by a bond may handle funds or other property for more than one plan.)

In general, ERISA does not cover plans established or maintained by governmental entities, churches for their employees, or plans which are maintained solely to comply with applicable workers compensation, unemployment or disability laws.

ERISA requirements apply to all employer-based health plans, whether fully insured through a third party or self-funded. But, governmental plans offered by local, state, or federal governments are generally excepted from ERISA requirements.

If a plan administrator does not timely provide such documents, ERISA Section 502(c)(1) allows a participant or beneficiary to sue a plan administrator and allows courts to impose monetary penalties of up to $110 per day (beginning on the date of the failure or refusal).
