The Form 5500 Series is part of Employee Retirement Income Security Act's (ERISA) reporting and disclosure framework intended to ensure that employee benefits plans are operated and managed in ance with prescribed standards.

Common types of employer-sponsored retirement accounts that fall under ERISA include 401(k) plans, pensions, deferred-compensation plans, and profit-sharing plans.

ERISA governs the claim only if ERISA covers the plan involved in the claim. ERISA applies to most employee benefit plans, including employee health and retirement plans. ERISA does not cover certain plans, such as government plans and church plans.

The Employee Retirement Income Security Act of 1974 (ERISA) is a federal law that sets minimum standards for most voluntarily established retirement and health plans in private industry to provide protection for individuals in these plans.

The employer maintaining the plan or the plan administrator of a Pension or Welfare benefit plan covered by ERISA. File Form 5500 to report information on the qualification of the plan, its financial condition, investments and the operations of the plan.

ERISA Reporting Forms These forms must be electronically filed each year by employee benefit plans to satisfy annual reporting requirements under the Employee Retirement Income Security Act (ERISA) and the Internal Revenue Code.

Who Should File The 5500-EZ. Owners of an Individual 401k plan are exempt from these annual tax filings until they reach $250,000 in assets. Once the individual 401k plan hits this level, you must file the IRS form 5500-EZ.
