Under normal circumstances when courts are open, a motion becomes "ripe" to rule upon after any opposition to the motion has been filed or the time to do so has passed. For most motions, that is 15 days from filing of the motion, plus an additional 3 days if the motion was mailed to the opposing party.

A motion to vacate one's conviction and/or sentence under Section 2255 will be referred to as a “motion to vacate” or “Section 2255.” A petition under Section 2241 will be referred to as a “habeas corpus petition.”

A 2255 appeal begins by filing a notice of appeal in the district court where the case is out of. A notice of appeal must be filed within 60 days of the judgment on the 2255 motion to vacate. That time period starts on the date on which the judgment is filed with the court.

A: 28 USC 2241 should be used for challenges related to the execution of the sentence, while section 2255 should be used to attack the validity of the conviction. Any challenge to conditions of confinement is properly brought under 28 USC 2241.

Length of the Process Once a defendant files a § 2255 motion, it can take anywhere from several weeks (in the event of a summary dismissal) to over a year (if the government is ordered to respond, and a hearing is held) for a court either to grant or dismiss a § 2255 motion.
