Description

The Foreign Corrupt Practices Act of 1977 resulted from bribery of foreign government officials by Lockheed Aircraft Company. This Act is designed to prevent the bribing of foreign officials in order to obtain foreign government contracts. Payments to foreign officials for “facilitation,” often referred to as grease payments, are not prohibited under FCPA so long as these payments are made only to get officials to do their normal jobs that they might not do, or would do slowly, without some payment. These payments can be made only to secure a permit or license; obtain paper processing; secure police protection; provide phone, water, or power supply; or similar such actions.

9 An entity or individual that is a resident in the US for tax purposes. 8BEN An individual who is not a tax resident in the US and is the beneficial owner of income. Not relevant for entities. 8BENE An entity that is not a resident within the US for tax purposes and is the beneficial owner of income.

Companies must ensure that foreign independent contractors comply with immigration laws by obtaining the necessary work permits and visas. It is important to research and understand the regulations specific to the contractor's home country and the country where the work will be performed.

8BENE for NonUSResident Entity Contractors. Form 8BENE is designed for nonresident alien (NRA) contractors operating as entities rather than sole traders. This form allows contractor entities to claim reductions or exemptions from US withholding tax based on their foreign tax residence, just like Form 8BEN.

An NC general contractor license is required for any project $30,000 or more. Navigating the North Carolina Licensing Board for General Contractors can be confusing. You must understand the licensing requirements, which type of license to apply for and how the application process works.
