The Fair Labor Standards Act (FLSA) requires most employers to give nonexempt employees overtime pay when they work extra hours. Any work in excess of 12 hours in one day shall be compensated at the rate of no less than twice the regular rate of pay for an employee.An employee may receive, in lieu of overtime compensation, compensating time off at a rate of not less than one and one-half hours for each hour of employment. Overtime wages are 1.5 times an employee's regular pay rate for each hour worked over 40 in a workweek. An eligible employee should receive overtime pay after working 8 hours in a single day. The FLSA states that all nonexempt employees are entitled to overtime pay for working over 40 hours in a workweek. The first eight hours worked in a workday are considered legal maximum regular hours, and any work beyond that constitutes overtime. In fact, California's labor laws are among the most progressive in the country.
