Filing a Complaint The Texas Workforce Commission Civil Rights Division (TWCCRD) Employment Discrimination Inquiry Submission System (EDISS) is the method to submit your employment discrimination complaint. It provides an ample amount of space to describe how you have been discriminated against.

Evidence takes several forms. It includes your testimony, which is the very first evidence gathered by EEOC. It also includes written materials such as evaluations, notes by your employer, letters, memos, and the like. You will be asked to provide any documents you may have that relate to your case.

Direct evidence of discrimination is usually found where an employer admits to the employee or someone else, verbally or in writing, that their intent or motive is to take an Adverse Employment Action (described above) against an employee because the employee is a member of a Protected Class.

Direct evidence is the best way to show that you experienced discrimination and can include verbal comments or statements written in memos, notes, emails, or other personal or professional communications.

Legal test for discrimination The individual has a protected characteristic (based on a protected ground). The individual suffered an adverse (negative) impact. The individual's protected characteristic was a factor in the adverse impact.

Unfortunately, it can be difficult to prove a wrongful termination was due to discrimination in the workplace because the employer may claim “pretext,” or false reason for the wrongful termination.
