On January 1, 2021, employees may start using accrued leave. This law empowers New York's low-wage workers and protects all consumers in the state.Under the paid time off law, employees in New York State accrue sick and safe leave at the rate of one hour off for every thirty hours worked. Overtime holiday pay is the premium pay that is required for work performed on specified holidays. Employers with 100 or more employees must provide up to 56 hours of paid leave each calendar year. The Fair Labor Standards Act (FLSA) does not require payment for time not worked, such as vacations, sick leave or federal or other holidays.
