Maryland is an employment-at-will state, which means that without a written employee contract, employees can be terminated for any reason at any time, provided that the reason is not discriminatory and that the employer is not retaliating against the employee for a rightful action.

Pursuant to Maryland law, employees are entitled to earn sick and safe leave at the rate of 1 hour for every 30 hours that an employee works up to a maximum of 40 hours per year.

Maryland leave laws allows employers the flexibility to determine whether unused PTO can be rolled over into the following year, and how much of it can carry over. The state's laws do not require PTO rollover; thus, it is up to each employer to establish a policy.

Legally, it's not against the law to put a person out on a leave of absence, but the law does generally prohibit them from doing so because of a person's disability. If you have a disability, they need to make reasonable accommodations at work instead of just putting you out.

The Family and Medical Leave Act (FMLA) gives workers up to 12 unpaid weeks per year to care for family members and themselves. Whether an employer may require employees to take involuntary unpaid time off depends on state leave laws and the contract or collective bargaining agreement.

That means that an employee in one of the situations above can expect to return to the same job and benefits that they had before their leave of absence. It's illegal for an employer to fire, demote, or otherwise punish an employee because they request or use their legally entitled right to work leave.

New employees must complete 6 months of State service before using annual leave; this leave is accrued based on years of service starting at 10 days per year.
