Roll Over (Carry Over, Brought Forward) A Use-It-or-Lose-It policy is permitted by state law. This means that an employer is not obligated to let employees carry over unused leave into the following year. The state of Maryland has no statute governing this policy.

California, Colorado, Nebraska, and Montana prohibit use-it-or-lose-it PTO policies. In these states, accrued PTO counts as earned wages and cannot be forfeited. Employers may limit future accruals but must compensate employees for any earned vacation upon termination.

New employees must complete 6 months of State service before using annual leave; this leave is accrued based on years of service starting at 10 days per year. Maryland law requires 0 vacation days.Employers aren't required to provide vacation leave. Duration: For every 30 hours worked, non-exempt employees can earn 1 hour of sick or family leave, and up to 40 hours per year can be accrued. 12 weeks of paid leave per benefit year. Employees are eligible if they have been working for the employer for at least 90 days. Maryland's Paid Sick Leave law grants employees the right to accrue paid sick leave based on the number of hours they've worked.
