Employers in NYS must provide certain employees with at least 24 consecutive hours of rest in any calendar week. Factory Workers are entitled to a 60-minute lunch break between a.m.For every four hours (or "major fraction" thereof) worked, the employer must allow the employee to take a ten-minute break. Employee meal breaks are required to be at least 30 minutes if an employee works six hours anywhere throughout New York state. If you work over 5 hours in a day, you are entitled to a meal break of at least 30 minutes that must start before the end of the fifth hour of your shift. If you have worked less than 6 hours in a day, you can agree to forego your meal break. You can also agree to take your meal break while on duty. Workers have a right to at least a 30minute meal break or each 6 hours worked in a calendar day. Generally, exempt workers are entitled to unpaid meal breaks, but not all of them are entitled to rest periods. An on-duty meal break is authorized in only very limited circumstances.
