Employers must comply with many different types of local payroll taxes. These taxes are based on where your employees work and/or live. Certain types of local taxes are only imposed on employers doing business in a locality.

Who must withhold personal income tax. If you are an employer as described in federal Publication 15, Circular E, Employer's Tax Guide, and you maintain an office or transact business within New York State, whether or not a paying agency is maintained within the state, you must withhold personal income tax.

Generally, you must withhold Illinois Income Tax for your Illinois employee if: you withhold federal income tax, or. you and your employee enter into a voluntary withholding agreement. (We do not require a separate agreement for payments covered by a federal voluntary withholding agreement.)

You can claim exemption from withholding only if both the following situations apply: For the prior year, you had a right to a refund of all federal income tax withheld because you had no tax liability. For the current year, you expect a refund of all federal income tax withheld because you expect to have no liability.

If your employer didn't have federal tax withheld, contact them to have the correct amount withheld for the future. When you file your tax return, you'll owe the amounts your employer should have withheld during the year as unpaid taxes. You may need a corrected Form W-2 reflecting additional FICA earnings.

Register as a new employer using the New Business Registration application (Form REG-1) on MyTax Illinois. This will create a withholding account with the Department of Revenue. Alternatively you can file forms REG-1 and UI-1 together by mail.

Generally, you want about 90% of your estimated income taxes withheld and sent to the government.12 This ensures that you never fall behind on income taxes (something that can result in heavy penalties) and that you are not overtaxed throughout the year.

If your employer is required to withhold the LST and does not, you should inform your employer that they are required to withhold and submit the LST. In some instances, the federal government does not withhold LST for its employees. In this case, the individual is responsible for paying the LST.
