Introduction. South Africa's Employment Equity Act, 1998, sets forth the foundation for employers' responsibilities around employment equity. Under the Act, Employers must create an employment equity plan, and comply with annual reporting requirements related to their plan.

South Africa has three main labour laws, namely the Basic Conditions of Employment Act, the Labour Relations Act, and the Employment Equity Act.

Employers cannot require minors under the age of 16 to work during school hours, work more than four hours before and after school hours, work more than 8 hours in a 24-hour period, work before 5 a.m. or after p.m. unless the next day is not a school day, work more than 40 hours in a week.

Ordinary hours of work (i.e. not overtime) may not be more than 45 hours in a week or 9 hours in a day. For employees who work a 6-day week, it is 8 hours per day. Any additional hours will be considered overtime for which a specified amount of additional remuneration is prescribed.

Basic Conditions of Employment Act (BCEA) This Act relates to the working conditions of employees by providing standard / basic conditions of employment. Some terms covered by the Act include leave, overtime, hours of work, etc.

How to File a Wage Claim. To print and file a wage claim, you must complete UALD's Wage Claim Assignment Form. Return the completed form to UALD by hand delivering it to our office, mailing it to the address listed on the first page of the form, or fax the form to us at (801) 530-7609.

As consequence of s79, a provision in a contract of employment prohibiting an employee from exercising her right to disclose his or her remuneration will be unenforceable. Further, any disciplinary action taken against an employee for exercising such a right will, most likely, be held to be unfair.
