State law says that an employee required to work more than 40 hours in a workweek is entitled to compensation for the excess hours. If you work more than 8 hours in a workday, you are entitled to overtime wages of oneandahalf your regular rate.On April 23, 2024, the U.S. Department of Labor (DOL) published its final rule raising the salary thresholds for overtime pay exemptions. Employees must be paid at least one and one-half times their regular hourly rate for any hours worked over 40 in a workweek. Overtime and compensatory time cards shall be filled out completely and legibly. Employees must satisfy all three tests (salary basis, salary level, and primary duties) to qualify as overtime exempt. This means that employees in the state must receive one and one-half times their regular wage rate for all hours worked over 40 in a workweek. The Fair Labor Standards Act (FLSA) regulates minimum wage, overtime pay and work hour requirements for most employees. This is absolutely illegal and violates the federal overtime laws.
