In general, when an individual resides in California, they are subject to California's comprehensive and protective labor laws regardless of where their employer is located. California laws also apply to those who are legal residents of other states but are working in California.
The California Labor Code provides that employees who work more than five (5) hours in a day are entitled to a thirty (30) minute meal break. However, if the employee is working no more than six (6) hours in a day, the employee may waive their meal break.
(1) All bid invitations and public works contracts shall contain appropriate language concerning the requirements of this chapter. (2) A prejob conference shall be conducted with the contractor and subcontractors to discuss federal and state labor law requirements applicable to the contract.
Form 11 PF is a self-declaration form that contains the EPF history of the employee and is mandatory for an employee to fill out upon joining an organization. It can also be used to transfer the PF account automatically.
(§1771) The contractor is responsible for ascertaining and complying with all current general prevailing wage rates for crafts and any rate changes that occur during the life of the contract. 1722. “Awarding body” or “body awarding the contract” means department, board, authority, officer or agent awarding a contract for public work.
1771.4(a)(2) – Duty to post or require the prime contractor to post job site notices, as prescribed by regulation. 1773.3 – Duty to provide notice to the Department of Industrial Relations of any public works contract within five days of the award using the online PWC-100 form.
