An additional 30-minute unpaid meal break when working more than 12 hours in a day. A paid 10-minute rest period for every four hours worked.Workers have a right to at least a 30minute meal break or each 6 hours worked in a calendar day. Employers must provide a second meal break of no fewer than 30 minutes for all workdays on which an employee works more than 10 hours. Nonexempt California employees must be given a meal or lunch break for a minimum of 30 minutes for shifts longer than five hours. An employee must be provided with a ten (10) minute uninterrupted rest break for every four (4) hours that they work in a day. If you have worked less than 6 hours in a day, you can agree to forego your meal break. You can also agree to take your meal break while on duty. Employer and employees may agree to break down the 10 minutes of rest into smaller breaks, as long as they add up to 10 minutes during the 4-hour work period. So while you may not necessarily be able to walk out of work, you could have a legal claim against your employer.
