Service of a summons and legal complaint via email, text message, and even social media has now been formally recognized in Illinois. According to new Rule 11(c), documents must be served via email unless certain exceptions apply.As of April 24, 2023 the Illinois Supreme Court now allows for service via email, social media or text message if properly motioned and given leave of court. O When you file a lawsuit against someone, you must fill out a Summons and have it delivered to the person you are suing. While selfrepresented parties may provide an email address and give their consent to electronic service, they are not required to do so. You should fill out and sign the Proof of Service section, which is found at the end of the Small Claims Summons. Only the clerk may mail the summons. Enter your complete address, telephone number, and email address, if you have one. If you do not check your email every day, you may miss important information, notice of court dates, or documents from other parties.
