FAQ

(b) Except as provided in Section 2030.070, no party shall, as a matter of right, propound to any other party more than 35 specially prepared interrogatories. If the initial set of interrogatories does not exhaust this limit, the balance may be propounded in subsequent sets.

If you do not respond, then the other side will request entry of default. The Court will then wait a period of time and then assume that you have waived the right to contest the allegations--they will be deemed proven true.

2030.020. (a) A defendant may propound interrogatories to a party to the action without leave of court at any time. (b) A plaintiff may propound interrogatories to a party without leave of court at any time that is 10 days after the service of the summons on, or appearance by, that party, whichever occurs first.

For interrogatories, action words such as “list,” “describe,” “identify,” or “state” are very useful. You may ask the other side to identify a document but you cannot use this form of discovery to get them to give it to you. Requesting documents requires a different kind of discovery process.

However, the U.S. Supreme Court ruled in Seattle Times Co. v. Rhinehart that “pretrial depositions and interrogatories are not public components of a civil trial. Such proceedings were not open to the public at common law, and, in general, they are conducted in private as a matter of modern practice.”

(a) A defendant may propound interrogatories to a party to the action without leave of court at any time. (b) A plaintiff may propound interrogatories to a party without leave of court at any time that is 10 days after the service of the summons on, or appearance by, that party, whichever occurs first.

You can use interrogatories to find out facts about a case but they cannot be used for questions that draw a legal conclusion.

The original form interrogatories and signed proof of service should be retained for your records. If the other party does not respond to your requests, you may use these documents to support a motion to have the court compel responses.

Form Interrogatories are a list of questions on a court form. Appropriate responses to interrogatories include providing an answer, denying knowledge, producing documents, or objecting to the interrogatory. When making interrogatories, you must create written questions, label them as "interrogatories," and demand the other party answer them in a letter. A party can also serve "form interrogatories" (pre-written interrogatories on a form). This packet provides general guidance about asking written questions, called "Interrogatories," to another party in the case. Interrogatories are a collection of written questions you can send to the opposing party in a lawsuit. A request for admission (RFA) allows one party to force another to admit or deny the truth of any relevant fact or the genuineness of any relevant document.
