THE BRADY RULE A deputy has an affirmative duty to disclose all favorable material evidence on the issue of guilt or punishment possessed by the prosecution team, irrespective of a defense request.

The Brady doctrine is a pretrial discovery rule that was established by the United States Supreme Court in Brady v. Maryland (1963). The rule requires that the prosecution must turn over all exculpatory evidence to the defendant in a criminal case. Exculpatory evidence is evidence that might exonerate the defendant.

A Brady motion is filed to compel the prosecution to turn over any favorable exculpatory evidence. In other words, a Brady motion is a defendant's request that the prosecution in a California criminal case hand over any potentially “exculpatory” evidence that might be favorable to the defense.

The Brady material has three components: “The evidence at issue must be favorable to the accused, either because it is exculpatory, or because it is impeaching; that evidence must have been suppressed by the State, either willfully or inadvertently; and prejudice must have ensued” concluded in the Strickler v.

If a Brady rule violation is discovered during trial, the court can either declare a mistrial or prohibit the prosecution from using unfavorable evidence which could be discredited by the withheld information.

Under the Brady-Giglio policy, federal prosecutors must disclose evidence that might exonerate you. The policy seeks full cooperation of law enforcement in gathering and disclosing Brady/Giglio information to the court and, ultimately, the defendant when such information is material and relevant to their case.

The Brady decision ruled that the defense has the right to examine all evidence that may be of an exculpatory nature. The prosecution will not only release evidence that the defendant might be guilty of a crime but also release all evidence that might show that the defendant is innocent as well.
