Florida's Electronic Mail Communications Act prohibits fraudulent, false or deceptive e-mail messages and the distribution of software designed to falsify information in the e-mail header, which would conceal the true origin of the e-mail message.

In Florida, service by publication requires that you publish a Notice of Action. To be approved for service by publication in a family law case, you must complete and file an Affidavit of Due Diligence. This affidavit shows the court the efforts you have made to locate and serve the other party in your case.

How Can I Serve Someone Electronically? The party requesting electronic service must first file a motion with the court and include a supporting affidavit stating the reasons why the recipient likely owns a specific email address, cellphone number, or social media account.
(1) Service by Electronic Mail (“e-mail”). All documents required or permitted to be served on another party must be served by e-mail, unless the parties otherwise stipulate or this rule otherwise provides.
