Read each question (interrogatory) very carefully. Answer only the question that is asked, and avoid the temptation to over-explain your answer. If the question contains several parts, you may break your answer into parts as well. It is also possible that you might object to the question.
If you filed a request for discovery and the other party will not answer or provide you with the information, you can file a Motion To Compel. This Motion asks the Court to force the other party to answer your requests. You can also ask the Court to sanction the other party for not answering your requests.
Be truthful. This is not a time to hide the truth or not answer accurately. Any false or misleading information could cause you to lose major issues in your parentage or divorce case. It could also cause you to be punished by the court and/or responsible for the other party's attorneys fees.
You have 30 days from the date the requests were served to serve your written response. Your response for each request must include either an agreement to comply, a representation of your ability to reply, or an objection to all or part of the request. How to serve a Response for written discovery Choose a server. You can't serve papers yourself. Figure out deadline to serve. Have your server mail the papers. Have your server complete the Proof of Service form. Copy the Proof of Service form.
How to fill out Form Interrogatories Fill in basic information at the top of the form. Provide basic information about your case. Select the questions. On Page 2, check the box next to each question you want to ask your spouse to answer. Make copies. Make 1 copy of the completed Form Interrogatories – Family Law.
Write out each fact you wish the other party to admit is true. When writing these facts, be as clear and concise as possible. Each request must be for a single fact; do not include multiple facts, compound questions, or subparts.
Discovery means you send the other side questions and requests for information or items (like documents) in writing. The other side must respond to your question or request in writing.
Unless agreed by the parties and with the permission of the court, all discovery shall be completed within 60 days of the demand, or 90 days of service of the summons and complaint, or counterclaim, or cross complaint, whichever is longer. This revision is advisable for several reasons.
