The protected amount is called the “homestead exemption.” All homeowners automatically have a homeowner's exemption, which protects part of their equity from involuntary sales (foreclosures). Recording a declaration of ownership extends this protection to voluntary sales.
It also offers relief on property taxes by reducing the taxable value of your home. The recent legislation, Assembly Bill 1885, significantly increased the California homestead exemption amounts. In 2024, the exemption ranges from a minimum of $349,720 to a maximum of $699,426, based on county median home sale prices.
You can file a declared homestead by taking these steps: Buy a declared homestead form from an office-supply store, or download a form from the Registrar-Recorder's website. Fill out the form. Sign the form and have it notarized.
The State of Alaska no longer offers the homestead and homesite programs of the 1970s, 1980s, and 1990s that allowed people to “claim” land. As an alternative to these programs, DNR offers the Remote Recreational Cabin Sites Staking Program to Alaska residents. Homesteading on federal land is no longer available.
Since the 1986 repeal, there has been no federal homesteading program in Alaska; the State of Alaska, however, created public land disposal programs starting with statehood in 1959. Initially, the state sold land primarily through auctions and then through land lotteries after 1978.
Declared Homestead. Currently, the California homestead exemption is automatic, meaning that a homestead declaration does not need to be filed with the county clerk. Under the new 2021 law, $300,000–$600,000 of a home's equity cannot be touched by judgment creditors.
