Solemn Form Probate This procedure requires notice to all heirs at law and becomes binding upon all parties immediately upon appointment of the executor. Heirs at law are the persons who would inherit the estate if there were no lawful will; heirs at law may or may not be beneficiaries under the will.
The Petition for Probate of Will and Letters Testamentary is requesting for the court to validate the Will and formally appoint the Executor. Once this is done, the court authorizes the Executor to oversee the process of distributing assets and property to beneficiaries per the instructions provided in the Will.
Any interested party or heir can file the Petition for Letters of Administration. The petition has to be completely filled out, including a complete listing of each and every heir of the deceased, each heir's age (or over 18), addresses, and relationship to the deceased.
The petition to probate will in solemn form is used when the deceased has a will; it is the most common probate petition. This probate petition's sole purpose is to ask the probate court for a determination of whether or not the will filed by the petitioner is the last will and testament of the deceased.
