Chapter covers common issues in trade mark laws and regulations including legislation, application, refusal, opposition and registration. To file a Notice of Opposition to oppose an application published in the Trade Marks Journal (FormTM5).The primary form is Form TMA, which may be filed with the Trade Marks Registry physically or online through the Intellectual Property India website. At present processing of TM application is done completely through TM electronic processing. Manual Filing and eFiling are the two different ways for filing the trademark registration application (form TMA). An ordinary application can be made in FORM TM-A along with the prescribed fee as mentioned in the Trademark Rules, 2017. An individual can file a trade mark application on their own, but it is recommended to hire an agent or attorney for it.
