Yes you are going to have to draft the documents. It is not as simple as just filing a lien lis pendens. In Arizona, lenders may foreclose on deeds of trusts or mortgages in default using either a judicial or non-judicial foreclosure process. A Lis Pendens Notice can be a powerful tool under Arizona law, but it is a narrow tool available only in limited circumstances. To file and record a lis pendens against real estate, the claimant must have made a "real property claim" in the underlying litigation. Within 5 days of filing suit, a lis pendens notice must be filed. This deadline can not be extended. The suit must involve title to the real property.
