A. A Lis Pendens (LP), also known as a Notice of Pendency, must be filed in NYSCEF if you are an attorney. The LP must comply with Art.Forms ; Answer Form and verification. PDF ; Notice of appearance and demand for complaint. Proof of service shall be filed within two days thereafter with the clerk of the court designated in the summons or notice. State law requires a lis pendens to be served on the property owner within 30 days after its recording. Historically known as lis pendens, a notice of pendency constructively gives notice of the ownership dispute to any potential thirdparty. Plaintiff also requests that, should the Court adhere to its decision, the cancelation of the notice of lis pendens be stayed pending appeal.
