A partition action is a lawsuit in which a court determines whether a property with two or more owners is to be partitioned or sold. A Partition is a type of lawsuit where a judge, or a court-appointed master will hear evidence and determine whether the property is to be divided or sold.A partition action is essentially a legal solution for co-owners who can't agree on what to do with their property. The procedure in an action for the partition of real estate shall be in accordance with the rules relating to the civil action.
