When two or more people own the same property, one of the owners CAN force a sale of the jointly owned property via a partition action or lawsuit. In most cases, a partition action cannot be stopped.However, there may be legal defenses that can prevent or slow a forced sale. The overwhelming majority of partition actions can't be stopped. There are only two things that can officially stop a partition action: fraud and duress. A partition lawsuit can be pretty difficult to stop, though it is not impossible with help from an experienced property dispute lawyer. This is a document through which the parties agree that particular property will be "separate property" and will not be divided. Exemption for the purchase of any items qualifying for exemption under this Agreement. But even though the act is particular to California, it is actually derived from the Uniform Partition of Heirs Property Act ("UPHPA").
