A partition action enables you to force the sale of property when coowners are refusing to sell. Any person who is receiving an allowance or benefit or any increases under this chapter may, at any time, waive his rights thereto, or to a portion thereof.A partition lawsuit can be pretty difficult to stop, though it is not impossible with help from an experienced property dispute lawyer. A partition agreement may be an express statement that the right to partition is waived. The separation agreement addresses more permanent matters: division and ownership of property, right to benefits and insurance, and medical coverage. In a partition action, one party can force the judicial sale of the property to the highest bidder with the net proceeds divided among the coowners. Each consent to a power of sale provided for in this section shall be filed in the probate court. Partition rights allow a cotenant to force the other owners to buy them out or force the land to be sold.
