Offer and acceptance in formation of contract. Acceptance: The other party agrees to the terms of the offer without making any significant changes.Consideration: Both parties exchange something of value. An offer is valid when it is definite enough and defined enough for someone to be able to accept it. Both parties must agree to all terms. Their minds must have "met" on every material term of the agreement or there will not be a valid contract. The offer should also identify a bargained-for exchange, creating a power of acceptance in the offeree. Every enforceable contract consists of three basic elements: offer, acceptance and consideration. In this module, we'll explore offer and acceptance. The offer is served on the adverse party and filed with the court.
