You have the right to appeal an overpayment determination. You must submit your appeal in writing within 30 days of the mailing date on the Notice of Overpayment (DE 1444). You can still submit an appeal after the 30-day deadline, but you must provide the reasons why you missed the appeal deadline.
If you are unable to repay the Overpayment Balance because of financial hardship, you may request that the Division of Unemployment Insurance stop collection efforts and waive the balance. To request a waiver, you must submit and complete sections, II, III, and IV on the reverse side of this form.
It takes about four weeks from the date you apply for benefits to know if you are eligible for benefits.
