You are an Illinois resident if you were domiciled in Illinois for the entire year. You do not have to be physically present in Illinois the entire year to be considered a full-year resident.Domicile is intended to be permanent rather than temporary, whereas residence means living in a particular locality and requires mere physical presence. The terms "domicile" and "residence" are often used interchangeably, but from a tax and legal perspective, they are not the same. For an independent student to be considered a resident of Illinois they must have physically resided in Illinois for 12 continuous full months. It is not unusual for people to relocate from Illinois to states with warmer climates and lower income taxes, such as Florida, Tennessee, Texas, and others. The IL-1040 is for Illinois only. If you resided in a different state for all or part of last calendar year, you will need to file paperwork for that state.
