The New York State WARN Act requires businesses to give early warning of closing and layoffs. WARN notices DO NOT need to be submitted to DOL from businesses that employ less than 50 full-time employees. The WARN Act applies to private businesses with 50 or more full-time employees in New York State.
New York State is an “Employment-at-Will” state. That means that an Employer may terminate an Employee at any time and for any legal reason or no reason at all. Likewise, an Employee may terminate his or her employment at any time.
A contract of employment (or employment contract) is an agreement or term of hire that is extended from an employer to an employee to set the terms and conditions of their employment. While usually a written document, these agreements can also be verbal.
The New York employment contract acknowledges an employee and the work they will bring to an organization. In return for their services, the contract would outline the wage, benefits, and bonuses that come with the standing. The income will be set as an hourly or salaried position based on the work provided.
