A Louisiana Small Succession Affidavit of Death and Warship is a document filed with the Louisiana Probate Court which is used to transfer the assets of a deceased person who died without a valid will. The affidavit is a sworn statement of the facts regarding the deceased person’s heirs and their entitlement to the assets and estate of the deceased. There are two types of Louisiana Small Succession Affidavit of Death and Warship. The first is a Louisiana Small Succession Affidavit of Death and Warship for an Intestate Succession, which is used when the deceased died without a valid will. The second is a Louisiana Small Succession Affidavit for a Testamentary Succession, which is used when the deceased had a valid will. In both cases, the affidavit must be completed and signed by two witnesses who can attest to the identity of the heirs and their right to the assets of the deceased. The affidavit must also include a valid death certificate, an itemized list of assets, a list of creditors, and the signature of all heirs. Once the affidavit is complete, it must be filed with the Clerk of Court in the parish of the deceased.
