A Louisiana Order for Relief from Stay (Ch 7 Vehicle) is an official court order that allows a creditor to repossess a vehicle from a debtor who has filed for Chapter 7 bankruptcy protection. This order allows creditors to take possession of the vehicle, even if it has been included in the bankruptcy filing. The order is issued by a judge in a bankruptcy court and applies to all vehicles owned by the debtor that are not exempt from repossession. There are two types of Louisiana Order for Relief from Stay (Ch 7 Vehicle): a Motion for Relief from Stay and an Adversary Proceeding. A Motion for Relief from Stay is filed by the creditor and requires a hearing before a judge, who will then decide whether to allow the creditor to repossess the vehicle. An Adversary Proceeding is initiated by the debtor and requires a trial to determine whether the vehicle should be repossessed.
