An Alaska Request for Review Hearing on Placement Denial is a hearing in which a parent or guardian can dispute and challenge a decision made by the Division of Juvenile Justice (DJ) to deny a request for placement of a juvenile. The hearing is an opportunity for the parent or guardian to present their case before an administrative law judge who will review the evidence and make a final determination. The hearing process begins with the filing of a Request for Review Hearing with the Alaska Department of Health and Social Services. The parent or guardian must provide all necessary documentation and evidence in support of their request for placement. Once the request is filed, a date for the hearing will be scheduled. At the hearing, the parent or guardian will have the opportunity to present their case and the DJ will present their case. The administrative law judge will review all evidence and testimony and make a final ruling. There are two types of Alaska Request for Review Hearing on Placement Denial: 1) an Emergency Request for Review Hearing and 2) a Non-Emergency Request for Review Hearing. An Emergency Request for Review Hearing is used when there is an immediate need to place a juvenile in a facility and the DJ has denied the request. A Non-Emergency Request for Review Hearing is used when the DJ has denied a request for placement, but the situation is not urgent.
