The Alaska Request for Hearing on Proof of Sobriety for Limited Driver's License Eligibility is a legal process used by individuals who have had their driver’s license suspended due to a chemical test refusal or failure. This hearing is conducted by the Alaska Division of Motor Vehicles (DMV) and allows the individual to present evidence that they are sober and can safely operate a motor vehicle. Those eligible to apply for a limited driver's license must have a valid Alaska driver's license, have had their license suspended, and must have completed an approved alcohol/drug evaluation and an approved treatment program. There are two types of Alaska Request for Hearing on Proof of Sobriety for Limited Driver's License Eligibility. The first type is the Standard Request for Hearing and the second type is the Expedited Request for Hearing. The Standard Request for Hearing is conducted when the individual is seeking reinstatement of a regular driver's license. The Expedited Request for Hearing is conducted when the individual is seeking reinstatement of a limited driver's license. Both types of hearings require the individual to submit evidence of sobriety and provide testimony of their efforts to remain sober. During the hearing, the DMV will consider evidence such as chemical test results, testimony, and documentation of treatment programs and other forms of rehabilitation. If the individual is deemed to be sober and able to safely operate a motor vehicle, the DMV may grant the individual a limited driver's license.
