An Alaska Request to Start Informal Probate and Appoint a Personal Representative When there is No Will is a petition filed with the court to start the probate process when a decedent has passed away without leaving a will. This petition will ask the court to appoint an individual or entity to serve as personal representative, also known as an administrator or executor, of the estate. There are two types of Alaska Request to Start Informal Probate and Appoint a Personal Representative When there is No Will: 1) The Petition for Informal Probate and Appointment of Personal Representative Without Will; and 2) The Petition for Informal Probate and Appointment of Personal Representative With Will. The former is for those estates where there is no will, and the latter is for estates with a will but where the will was not properly filed with the court. Both types of petitions generally require the same information, such as the decedent's name and date of death, information on the assets of the estate, and the name and address of the person or entity that will be appointed as personal representative. In addition to filing the petition, other documents such as the decedent's death certificate, a list of heirs, and a creditors list must also be filed with the court. The court will review the documents and, if approved, will issue an order appointing a personal representative and authorizing them to manage the estate.
