The Alaska Parent’s Waiver of Notice to Indian Tribe is a document that allows a parent to waive their right to be notified of a proceeding involving their Indian child. It is typically completed and signed by the parent in the presence of a notary public or an Indian Child Welfare Act (IOWA) social worker. The Waiver of Notice is used in Indian Child Welfare Act (IOWA) cases when the parent or Indian custodian does not wish to be notified of any proceedings related to the Indian child. There are two types of Alaska Parent's Waiver of Notice to Indian Tribe: (1) Waiver of Notice of Petition to Terminate Parental Rights and (2) Waiver of Notice of Foster Care Placement or Adoption. The Waiver of Notice of Petition to Terminate Parental Rights allows a parent to waive their right to notice of any proceedings to terminate their parental rights in regard to their Indian child. This waiver must be signed in the presence of a notary public or an IOWA social worker. The Waiver of Notice of Foster Care Placement or Adoption allows a parent to waive their right to notice of any proceedings to place their Indian child in foster care or to adopt their Indian child. This waiver must also be signed in the presence of a notary public or an IOWA social worker.
