Alabama Garnishment Instructions are the legal procedures for creditors to collect debt from a debtor's wages in the state of Alabama. There are two types of garnishment instructions in Alabama: wage garnishment and bank account garnishment. Wage Garnishment: A creditor may seek court-ordered wage garnishment to collect on a debt. The amount of income that can be garnished is limited to the least of 25% of the debtor’s disposable income or the amount by which the debtor’s disposable income exceeds 30 times the federal minimum wage. Bank Account Garnishment: A creditor may also seek court-ordered bank account garnishment, which allows the creditor to seize funds in a debtor’s bank account to satisfy a debt. The funds are then transferred to the creditor, up to the full amount of the debt. In both cases, the creditor must file the appropriate paperwork with the court and serve it on the debtor. The debtor then has the opportunity to respond and dispute the garnishment. If the debt is not disputed, the garnishment will be granted and the creditor will be able to collect on the debt.
