The Alabama Ex Parte Elder Abuse Protection Order is a court order issued by a judge when an elderly person is in imminent danger of physical or emotional harm due to abuse, neglect, or exploitation. This order is designed to protect the elderly person from further harm and to provide them with the necessary resources to safely remain in their home or living situation. The order may also require the alleged abuser to stay away from the elderly person and to refrain from any contact or communication. There are three different types of Alabama Ex Parte Elder Abuse Protection Orders: Temporary Ex Parte, Permanent Ex Parte, and Emergency Ex Parte. A Temporary Ex Parte Order is set for a period of up to 14 days and may be issued without the accused abuser present. This order is designed to provide immediate protection to the elderly person while the court determines whether a Permanent Ex Parte Order is necessary. A Permanent Ex Parte Order is effective for a period of up to one year and may be issued without the accused abuser present. This order provides long-term protection for the elderly person from any further harm. An Emergency Ex Parte Order is set for a period of up to 24 hours and is specifically designed to provide immediate protection to the elderly person when there is an immediate danger of abuse, neglect, or exploitation. This order may be issued without the accused abuser present.
