Alabama Order of Arrearage-Contempt Nonpayment of Support is a form of enforcement of a court ordered obligation to pay child support, spousal support, or both. This type of order is issued when a person has failed to pay the required support payments as ordered by the court. The order requires that the obligated parent or spouse pay the arbitrage in full or face criminal contempt proceedings. There are two types of Alabama Order of Arrearage-Contempt Nonpayment of Support: an Order to Show Cause and an Order of Arbitrage Withhold. An Order to Show Cause requires the obligated parent or spouse to appear before the court and show proof of payment of the arbitrage or face contempt proceedings. An Order of Arbitrage Withhold requires the obligated parent or spouse to have a portion of their wages or income withheld and paid to the court, which will then be used to pay the arbitrage.
