An Alabama Permanency Hearing Order Kinship Guardianship (WHO) is a legal process that establishes a guardianship relationship between a child and a relative or other caring adult. This type of guardianship is available to children who cannot live with their parents due to abuse or neglect, or when the parents are unable to adequately care for them. The WHO is a court order that grants legal guardianship to the relative or other caring adult and outlines the rights, responsibilities, and duties of the guardianship relationship. The WHO also includes provisions for the child’s care, including access to health care, education, and other services. There are two types of WHO Kinship Guardianship in Alabama: Temporary WHO Kinship Guardianship and Permanent WHO Kinship Guardianship. Temporary WHO Kinship Guardianship are established when there is a temporary need for guardianship, such as when the parents are unable to provide for the child’s care or when the parents are in a situation that requires temporary guardianship. Permanent WHO Kinship Guardianship are established when guardianship is needed on a permanent basis and there is no expectation that the parents will be able to care for the child in the future.
