Alabama LR 4003-2 Order on Section 522(f) Motion to Avoid Judicial Lien or Nonpossessory, Nonpurchase Money Security Interest and Determine Secured Status (Effective Dec. 1, 2017) is a court order issued by the Bankruptcy Court in order to determine the secured status of a debtor's assets. This order applies to motions filed under Section 522(f) of the U.S. Bankruptcy Code, which allow a debtor to avoid judicial liens or nonpossessory, nonpurchase money security interests in their property. This order outlines the procedures for filing a motion to avoid these liens or security interests, as well as the requirements for determining the secured status of the debtor's assets. The order applies to both consumer and commercial debtors. There are two types of Alabama LR 4003-2 Order on Section 522(f) Motion to Avoid Judicial Lien or Nonpossessory, Nonpurchase Money Security Interest and Determine Secured Status (Effective Dec. 1, 2017): (1) Order on Motion to Avoid Judicial Lien or Nonpossessory, Nonpurchase Money Security Interest and Determine Secured Status (Consumer Debtor); and (2) Order on Motion to Avoid Judicial Lien or Nonpossessory, Nonpurchase Money Security Interest and Determine Secured Status (Commercial Debtor).
