The Alabama Conflict Disclosure Statement (ACTS) is an agreement developed by the Alabama State Bar Association that requires lawyers to disclose information about any conflicts of interest that may arise in a legal matter. It is designed to protect clients from any potential conflicts of interest that could arise from a lawyer's prior or current business, personal, and financial relationships. It requires lawyers to disclose information about their prior and current relationships, business interests, and financial activities that could affect their professional judgment or loyalty to their clients. The ACTS are divided into four parts: the Conflict Disclosure Summary, Conflict Disclosure Statement, Conflict Disclosure Waiver, and Conflict Disclosure Acknowledgment. The Conflict Disclosure Summary requires the attorney to state any existing or potential conflicts of interest that may arise in the legal matter. This includes any business, personal, or financial relationships the attorney may have with the client or any other party to the legal matter. The Conflict Disclosure Statement requires the lawyer to provide detailed information about any potential conflicts of interest. The Conflict Disclosure Waiver allows the client to waive the conflict disclosure requirements if they choose to do so. The Conflict Disclosure Acknowledgment requires the client to sign and date the document to acknowledge that they have read and understood the conflict disclosure statement.
