An Arkansas Affidavit of Eviction is a legal document used to remove a tenant from their rental property in the state of Arkansas. It is used when a landlord has taken all the necessary steps to terminate the tenant’s lease and has been unsuccessful in getting the tenant to leave voluntarily. The type of affidavit used depends on the type of tenancy; the two most common types are Non-Payment of Rent and Holdover. The Non-Payment of Rent Affidavit is used when a tenant is behind on their rent payments and the landlord has served the tenant with a Notice to Quit. The affidavit is used to start the eviction process; it must be filed with the Arkansas District Court. The Holdover Affidavit is used when a tenant has stayed beyond the date their lease was set to end, or when a landlord has failed to renew a month-to-month tenancy. The affidavit must be filed with the Arkansas District Court and served to the tenant, who then has seven days to respond. If the tenant does not respond, the landlord can then start the eviction process.
