An Arkansas Counter Claim is a legal document used in Arkansas civil court proceedings. It is a response to a Complaint filed by one party against another. A Counter Claim is an affirmative defense that is used by the Respondent to assert their own legal claims against the Plaintiff in the same action. A Counter Claim is essentially a Complaint in reverse, as the Respondent is now bringing claims against the Plaintiff. There are three main types of Arkansas Counter Claim: Permissive Counter Claim, Compulsory Counter Claim, and Cross-Claim. A Permissive Counter Claim is a claim made by a defendant against the plaintiff that is not related to the original cause of action. A Compulsory Counter Claim is a claim made by the defendant that is related to the original cause of action. A Cross-Claim is a claim made by one defendant against another defendant. All Counter Claims must be filed in the same court that the original Complaint was filed in.
