Arizona Petition for Recognition of Foreign Proceeding is a legal document or a set of documents used to obtain recognition of a foreign insolvency proceeding in the state of Arizona. This petition seeks permission from the state court to recognize a foreign insolvency proceeding and the associated foreign representative in the state. It is also used to ask the court to extend the same benefits and protection as given to domestic insolvency proceedings in Arizona. There are two types of Arizona Petition for Recognition of Foreign Proceeding, namely: Chapter 15 Petition and Chapter 11 Cross-Border Petition. A Chapter 15 Petition is filed by a foreign representative to the Arizona court to recognize a foreign insolvency proceeding and the related foreign representative. A Chapter 11 Cross-Border Petition is used when a foreign debtor, a domestic representative, or a foreign representative seeks recognition of a foreign main proceeding for the purpose of restructuring the foreign debtor’s debts. Both types of petitions must be accompanied by sufficient evidence and documentation to support the application.
