Arizona Chapter 12 Hardship Discharge is a type of bankruptcy that is available to individuals who are unable to pay their debts due to a severe financial hardship. This type of discharge allows debtors to have their debts discharged without having to go through a full bankruptcy process. The discharge is available to those who meet certain criteria, including: having a low income, owning little to no property, and having no other feasible means of paying off their debts. There are two types of Arizona Chapter 12 Hardship Discharge: the first is a Hardship Discharge without the filing of a bankruptcy petition, and the second type is a Hardship Discharge with the filing of a bankruptcy petition. In both cases, the court must review the debtor’s financial situation and determine whether the debtor is eligible for the discharge. If the court determines that the debtor is unable to pay back their debts and there is no other feasible means of paying them off, then a Hardship Discharge will be granted.
