Arizona Chapter 13 Hardship Discharge is a bankruptcy option that allows the debtor to obtain a discharge of their remaining unsecured debts after completing a three- to five-year repayment plan. Through the repayment plan, the debtor must make regular payments to the bankruptcy trustee who distributes the payments to creditors. In order for a debtor to qualify for a Chapter 13 Hardship Discharge in Arizona, the debtor must demonstrate that they have experienced financial hardship that has prevented them from completing the repayment plan. There are two types of Arizona Chapter 13 Hardship Discharges: the “hardship discharge” and the “hardship discharge in lieu of completion.” The hardship discharge is granted after the debtor has completed the repayment plan and meets the requirements for a hardship discharge. The hardship discharge in lieu of completion is granted if the debtor has not completed the repayment plan, but still meets the requirements for a hardship discharge.
