An Arizona Anticipatory Search and Seizure Warrant is a court-issued document that authorizes law enforcement personnel to search a specific place for evidence of a crime before it is actually committed. It is issued on the basis of probable cause that a crime will occur in the near future and that the evidence of the crime will be located in the specified area. This type of warrant is commonly used to search for contraband, such as weapons or drugs, which are likely to be used in the commission of the crime. There are two types of Arizona Anticipatory Search and Seizure Warrants: ex parte and on-notice. An ex parte warrant is issued without prior notice to the person whose property is to be searched and can only be issued if there is a risk of immediate danger to the public if the warrant is not granted. An on-notice warrant requires prior notice to the person whose property is to be searched, and typically requires the submission of sworn testimony or other evidence in support of the warrant.
